These Terms and Conditions ("Terms") govern your access to and use of the website available at www.testlibrary.com, the "TestLibrary" software application, and all related features, content, assessment tests, and subscriptions (collectively, the "Services") provided by Aura Health LLC ("Platform Operator").

By accessing the Website, creating an account, or purchasing a subscription, You acknowledge that You have read, understood, and agree to be bound by these Terms. If You do not agree, You must not use the Services.

Eligibility

You must be at least eighteen (18) years old, or have reached the age of legal majority in Your jurisdiction, to access the Services or purchase a Subscription. By using the Services, you represent that you meet these age requirements and have the legal capacity to enter into a binding agreement.

The Services are not intended for use by children. If we become aware that data of a minor has been collected without consent, we reserve the right to terminate the associated Account.

Data Protection & Privacy

Your privacy is a priority. The collection and use of your personal information are governed by our Privacy Policy, which forms an integral part of these Terms. By using the Services, you acknowledge that you have read and understood our data practices.

Dispute Resolution & Arbitration

PLEASE READ THIS SECTION CAREFULLY. Before initiating formal legal proceedings, You agree to attempt to resolve any dispute informally by contacting [email protected].

  • Governing Law: These Terms are governed by the laws of the United States of America.
  • Arbitration Agreement: Except where prohibited by law, arbitration shall be the exclusive means of resolving any Claim. You expressly waive the right to a jury trial or to participate in a class action.
  • Waiver of Class Actions: All Claims must be brought solely in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

User License and Account Security

Subject to compliance with these Terms, the Platform Operator grants You a limited, non-exclusive, revocable license for personal, non-commercial use.

You are solely responsible for maintaining the security of Your Account credentials. If You suspect unauthorized access, notify us immediately. We reserve the right to suspend or terminate Accounts that violate these Terms or engage in fraudulent activity.

How the Services Work

The Services enable Users to complete digital assessment tests and receive personalized reports ("Reports"). These Reports are generated automatically based on user responses and are provided for informational and educational purposes only.

You acknowledge that the Services do not provide medical, psychological, or legal advice. Any reliance on the Reports is at Your own risk.

Fees, Trial & Subscription Plans

Certain Services are offered for a fee. By completing a purchase, You authorize the Platform Operator to charge Your selected payment method.

Payment Processing. Depending on Your payment method and/or Your location, Your payment may be processed by either: (a) Aura Health LLC, or (b) Revuelto Sàrl, a company registered in Luxembourg, with its registered office at 10 Rue Mathias Hardt, L-1717 Luxembourg. The applicable processing entity will be identified at checkout. Regardless of which entity processes Your payment, these Terms apply in full and the Platform Operator remains responsible for the delivery of the Services.

Trial Membership: New Users may be offered a 7-day Trial (typically USD 1.95). Automatic Renewal: Unless cancelled, the Trial will automatically convert into a paid Subscription (typically USD 29.95 every 28 days). Billing Cycles: Charges are made in advance for each Subscription Period. If a payment fails, we may attempt to reprocess it for up to 14 days.

Cancellation Policy

You may cancel Your Trial or Subscription at any time via Your Account settings or by contacting [email protected].

To avoid charges for the next period, cancellation must be completed before the end of the current cycle. Once a new Subscription Period begins, the fee is non-refundable. Upon cancellation, access remains available until the end of the paid period.

Refund Policy

All purchases for digital services are final and refunds are not guaranteed.

  • Chargebacks: Initiating a chargeback without first contacting support constitutes a material breach of these Terms and may result in Account termination and reporting to fraud protection databases.
  • EU Right of Withdrawal: EU consumers acknowledge that by requesting immediate access to digital content, they expressly waive their 14-day right of withdrawal once the performance of the service has begun.

Intellectual Property

All content, algorithms, trademarks (including "TestLibrary"), and Reports are the exclusive property of the Platform Operator. You may not copy, modify, distribute, or commercially exploit any part of the Services without express written consent. You retain ownership of your submitted data but grant us a license to process it to provide the Services.

Not Healthcare Advice

The Services are provided for entertainment and educational purposes only. The assessment tests are not clinical tools and are not intended to diagnose, treat, or prevent any disease or medical condition. The Services are not a substitute for professional medical, psychological, or psychiatric advice. Always consult with a qualified healthcare professional before making health-related decisions.

Third-Party Websites

The Services may contain links to third-party websites. We do not control or endorse these external sites and are not responsible for their content or privacy practices. Accessing them is at Your own risk.
